GDPR Clause

On May 25, 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (“GDPR”), came into force in Poland. As we place particular importance on the right to privacy, we would like to provide you with information regarding the processing of personal data.

I. Personal Data Controller

The personal data controller is “ANITEX Spółka z ograniczoną odpowiedzialnością”, with its registered office at 42-221 Częstochowa, ul. Gminna 10, operating on the basis of an entry in the Register of Entrepreneurs of the National Court Register under number KRS: 0000749718, NIP: 5732905559, REGON: 381380556, with share capital of PLN 16,259,000.00.

II. Purpose and legal basis for personal data processing

Personal data are processed for the following purposes:

  1. taking action at your request prior to entering into a contract (the legal basis for processing is Article 6(1)(b) of the GDPR)
  2. performance of the contract based on Article 6(1)(b) of the GDPR, and to the extent that providing data is optional – based on your consent, i.e., Article 6(1)(a) of the GDPR
  3. fulfilling legal obligations imposed on the Controller under generally applicable law (the legal basis for processing is Article 6(1)(c) of the GDPR)
  4. pursuing the legitimate interests of the Controller, which include the possible establishment, exercise or defence of legal claims (the legal basis for processing is the legitimate interests of the Controller, i.e., Article 6(1)(f) of the GDPR)

III. Data retention period

Personal data will be processed for at least one year after the contract has been performed, unless the parties have agreed otherwise in the contract. In the case of data provided optionally — until consent is withdrawn, but no longer than for the duration of the contract. The processing period may be extended by the limitation period for claims or for the defence against such claims by the Controller. After this period, the data will be processed only to the extent and for the time required by law, including accounting regulations.

IV. Recipients of personal data

The data may be transferred to employees, collaborators, providers of IT systems and IT services, postal and courier operators, entities providing services to the Controller necessary for the performance of the contract concluded with you, and authorities entitled to receive your data under the law.

V. Profiling

Your data will not be subject to profiling.

  1. Rights of data subjects

You have the right to access your data, receive a copy of it, rectify and delete it, transfer it, restrict processing, object to the processing of data, withdraw consent at any time, and lodge a complaint with the President of the Personal Data Protection Office.

VII. Information on the voluntary or mandatory provision of personal data

Providing personal data is necessary to conclude and perform the contract, except for data marked as optional, which may be provided voluntarily. You are not obliged to provide such data, but failure to do so will make it impossible to execute the contract and to contact you.

VIII. Cookies 

While using the website http://anitex.pl/, your data such as IP address, domain name, browser type, and operating system are automatically collected.
The data are gathered via cookies and the Google Analytics system (web analytics tool) and may also be recorded in server logs. Access to this information is limited to the personal data Controller and, for technical reasons, trusted entities whose technologies we use.

The collected data are used to ensure the proper functioning of the website, monitor session status, and generate website viewing statistics. Session cookies remain on your device until you leave the website or close your browser, while persistent cookies stay until the time specified in the file parameters or until you manually delete them.
